First Round ("we", "our", or "us") respects your rights as a user and wants to be transparent about how our service works. These Terms of Service ("Terms") govern your use of our app and services. By creating an account or using First Round, you agree to these Terms.
1. Eligibility
To use First Round, you must:
- Be of legal age to use the service and accept our age eligibility declaration
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the service under applicable law
Joining does not automatically grant active membership. Profiles may require approval before you can participate in discovery or send drinks.
2. Your Account
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Providing accurate and up-to-date information

3. Acceptable Use
You agree not to use First Round to:
- Harass, threaten, or harm other users
- Share false, misleading, or harmful content
- Create fake profiles or spam invitations

- Attempt to gain unauthorized access to any part of the service
- Use automated tools to scrape or extract data
We reserve the right to warn, suspend, or terminate accounts that violate these rules, and to review member reports for safety.
4. User Content
You retain ownership of the content you create on First Round. By posting content, you grant us a limited, non-exclusive license to display and distribute it within the service.
You are solely responsible for the content you share. We do not endorse any user-generated content.
5. Drink invitations and payments
First Round enables prepaid drink invitations at partner restaurants. By confirming an invitation, you agree to:
- Pay the displayed drink price and any platform charges
- Provide accurate billing information
- Accept that refunds or credits follow First Round’s then-current policy
Membership or partner plans shown on the marketing site may change. Restaurant settlements and voucher redemption are subject to partner terms and availability.
6. Intellectual Property
All content, design, and technology within First Round — including the name, logo, and app interface — is owned by First Round and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the service without our prior written consent.
7. Disclaimers
First Round is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- That every invitation will be accepted or redeemed
- That the service will meet your specific requirements
- The conduct of other members or partner restaurants
8. Limitation of Liability
To the fullest extent permitted by law, First Round shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.
9. Termination
We may suspend or terminate your access to First Round at any time if you violate these Terms or for any other reason at our discretion. You may delete your account at any time from the app settings.
10. Changes to These Terms
We may update these Terms from time to time. We will notify users of significant changes. Continued use of First Round after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
